California would join nine other states and Washington D.C. in making source of income discrimination illegal by landlords.<\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>After waiting for several months or years on a waiting list to finally obtain\u00a0a Section 8 Housing Choice Voucher, the final\u00a0step to receive rental assistance has been a significant hurdle for many voucher holders.\u00a0After receiving\u00a0a housing\u00a0voucher, the search begins to find a landlord that will accept that voucher. However, many\u00a0voucher holders lose their voucher because they\u00a0were not able to find a landlord willing to accept their voucher within the required\u00a0time frame.<\/p>\n<p>In many\u00a0cases, this is because landlords refuse to rent to potential tenants who receive housing assistance, and reject them based solely on their form of payment, a federal housing subsidy.<\/p>\n<p>But this unique form of housing discrimination may be coming to an end in many parts of the country.<\/p>\n<p>Over the last few years, there have been significant efforts at state and municipal government levels\u00a0to enact legislation that makes\u00a0such discrimination illegal.<\/p>\n<p>According to <a href=\"http:\/\/scorecard.assetsandopportunity.org\/latest\/measure\/protection-from-discrimination-for-low-income-renters\">the Corporation for Enterprise Development<\/a>, as of 2015, nine states &#8211; Connecticut, Hawaii, Maine, Massachusetts, New Jersey, North Dakota, Oklahoma, Oregon, and Vermont &#8211; along with the District of Columbia\u00a0have already passed bills outlawing discrimination against low-income renters. Cities and counties that have adopted similar anti-discrimination policies include Los Angeles, Miami-Dade County, New York City, Philadelphia and Seattle.\u00a0To find out if source of income\u00a0discrimination has been outlawed in your area, you may contact the\u00a0local housing authority. (<a href=\"http:\/\/affordablehousingonline.com\/\">Search for your housing authority here<\/a>.)<\/p>\n<p>&nbsp;<\/p>\n<figure id=\"attachment_1226\" aria-describedby=\"caption-attachment-1226\" style=\"width: 596px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1226 \" src=\"http:\/\/affordablehousingonline.com\/blog\/wp-content\/uploads\/2016\/03\/Map.png\" alt=\"Map\" width=\"596\" height=\"268\" \/><figcaption id=\"caption-attachment-1226\" class=\"wp-caption-text\">The highlighted states have passed bills outlawing the discrimination of renters based on income (Please note, the coloring of Massachusetts was a design choice, and does not have any significance.)<\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>And this list will likely continue to grow, as America&#8217;s largest state by population\u00a0may soon pass a bill to make source of income discrimination illegal.<\/p>\n<p>In February 2016, Senator Mark Leno of San Francisco introduced <a href=\"http:\/\/www.leginfo.ca.gov\/pub\/15-16\/bill\/sen\/sb_1051-1100\/sb_1053_bill_20160216_introduced.html\">Senate Bill 1053<\/a> that would forbid landlords in the State of California to discriminate against renters\u00a0specifically because of their source of income.<\/p>\n<p>The main elements of the proposed bill forbid landlords to discriminate against prospective tenants based on their income; instigate written or oral inquiry on a tenant concerning their source of income; and publish a notice, statement or advertisement indicating a\u00a0preference, limitation, or discrimination based on income.<\/p>\n<p>When searching online for rentals, many advertisements can be found online stating &#8220;No Section.&#8221; If this bill passes, California\u00a0landlords will no longer be able to make this statement.<\/p>\n<p>It is important to note that under this law, landlords may still deny tenants based on credit, criminal or rental history. However, if a\u00a0landlord denies the voucher holder\u00a0simply because of the tenant&#8217;s income status, that landlord could be named in a discrimination complaint.<\/p>\n<p>These policies protecting low-income renters have been signed into law because of the\u00a0need to meet the extremely high demand of affordable housing.<\/p>\n<p><a href=\"http:\/\/apps.urban.org\/features\/rental-housing-crisis-map\/\">According to the Urban Institute<\/a>, in 2013,\u00a0only about 28% of extremely low-income\u00a0(ELI) renters lived in affordable housing units. This figure was a steep drop from 37% of ELI renters in 2000. An example of the specific need for affordable housing in California was highlighted by housing data for Alameda County, in which\u00a0Oakland is\u00a0its county seat. In 2013, there were more than 19,000 available affordable housing units for ELI\u00a0renters, yet nearly 75,000 ELI households in Alameda County. To visualize the difficulty in finding a landlord that will accept your voucher in Oakland, only 115 of the 609 voucher recipients, or 18.9%, in the area found a unit with their voucher in 2015.<\/p>\n<p>To combat this growing problem facing the Housing Choice Voucher program, some housing authorities, such as <a href=\"http:\/\/www.timesfreepress.com\/news\/local\/story\/2015\/sep\/16\/chattanooghousing-authority-hosts-landlord-fa\/325354\/\">the Chattanooga Housing Authority (CHA) in Tennessee<\/a>,\u00a0have gone above and beyond to assist\u00a0voucher holders in finding a unit. The CHA, which has seen as many as two thirds of all new voucher recipients lose their vouchers because they can&#8217;t locate a landlord willing to accept their voucher, now\u00a0hosts landlord fairs. In these events, approved landlords who accept Section 8 vouchers are spread throughout a room much like a job fair. Voucher holders are given face-to-face interaction with several landlords, which eliminates much of the challenge in finding a rental unit.<\/p>\n<p>The proposed California policy would make it significantly easier for voucher holders to find a unit in the State of California, as landlords would not be able to deny Section 8 tenants simply because of their source of income.\u00a0However, it is important that interested persons contact\u00a0their representatives\u00a0to inform them of how important this legislation is for low-income renters.<\/p>\n<p>&nbsp;<\/p>\n<figure id=\"attachment_1234\" aria-describedby=\"caption-attachment-1234\" style=\"width: 400px\" class=\"wp-caption alignnone\"><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-1234\" src=\"http:\/\/affordablehousingonline.com\/blog\/wp-content\/uploads\/2016\/03\/TexasCapitol.png\" alt=\"TexasCapitol\" width=\"400\" height=\"269\" \/><figcaption id=\"caption-attachment-1234\" class=\"wp-caption-text\">To avoid legislation in your area similar to\u00a0the Texas Senate preventing laws that protect low-income renters to be passed, contact your representatives. (Texas State Capitol building pictured.)<\/figcaption><\/figure>\n<p>&nbsp;<\/p>\n<p>Although the City of Austin, TX passed a law just like California&#8217;s proposed bill, <a href=\"http:\/\/www.austinchronicle.com\/news\/2015-09-04\/not-for-rent\/\">it was later overturned by the Texas Senate<\/a>.
